Valid and Completed I-9 Employment Verification Is Must
The U.S. Citizenship and Immigration Services present the I-9 employment verification program used by employer to verify employee’s identity and his eligibility to work in US distinguished by the United States government. The Immigration Reform and Control Act 1986, (IRCA) demands employees to verify their facially valid documentation to verify their original identity and their legal authorization to work legally inside the boundaries of the United States. The I-9 Employment Verification form proposed and provided to all such employees for this sole purpose by the US Federal Government.
According to the IRCA act of 1986, every employee hired after November 1986 must possess and complete the credentials required in the I-9 Employment Verification form. The section 1 of the form should be filled before starting the work whereas Section 2 required to be filled after three or four days after the employee commences work in the establishment. According to the norms of the form, I-9 employer is solely responsible to check and ensure that filling of form, its submission and proceeding in timely manner to avoid further legitimate matters. Although this form is not required from the unpaid volunteers and contractors unexpected trouble may follow if federal government finds out the contractor working for a company employees unauthorized workers.
For submission of the I-9 Employment Verification form employee must submit original documents as photocopies of the same are not allowed exception granted to the certified copy of the birth certificate. After submission, of these documents employer should mention the eligibility and identity documents presented by the employee and record the same on documented information on the I-9 form.
Along with the form, a list of required documents is provided to the employees in form of three lists List A, List B and List C. All the employees filling I-9 Employment Verification form must produce either one of the documents from List A or one of the documents from List B and one of the documents in List C. List A consists of doc8ument list that establishes both identity and employment eligibility like United States Passport, Temporary resident card, Employment Authorization Document etc. List B contains document list consisting of documents to establish employee’s identity only like Drivers License or ID card issued by state or outlying possession, Native American tribal Document etc. List C contains document list that establishes employment eligibility like social security account number card without employment restrictions, certification of birth abroad, US citizen ID card etc.
Any employee who fails to produce required documents or a receipt for replacement document in case of lost, stolen or destroyed documents within three business days after the beginning of employment face termination of their employment. On showing, the receipt for inability to produce original documents will be given ninety days to present the original documents. Therefore, before starting for job search make sure you have all the paperwork ready and in place to avoid future legal hindrances.
